rushing aside all the norms and rules of Srinagar Municipal Committee (SMC), owner of a multi storey commercial structure in Nawich Bagh, Barzulla area of Srinagar city dares the concerned for the past four years to act.
The residents of Nawich Bagh, Baghat Barzulla have gone pillar to post against the gross violation by the owner of the commercial structure, but authorities seem to be helpless despite admitting the grave mistakes done during approval process.
The said building being constructed in Nawich Bagh, Baghat Barzulla area of Srinagar city sparks row as residents claim that the building is being designed to be used for commercial purposes and constructed in violation of the building permit.
“The construction has been designed to be used for commercial purposes and we took up the matter with the owner many times but he always maintained that he was not going to use it for commercial purposes,” locals said.
“Permission of this commercial structure should be checked and verified as per Master Plan and the action should follow as per Municipal Act,” said locals.
An official of the Srinagar Municipal Council told that permission was granted to the owner of the building for the construction of a two-story residential complex which was later modified for the construction of a three-story building with an attic.
The structure has breached the privacy of the entire locality in addition to the violation of permission granted.
Meanwhile, SMC has put permission in abeyance and construction has been stopped. Locals demand cancellation of the permission for violation of “Master Plan Project” and permission initially granted as they have apprehension that the owner will be allowed to carry out further construction in the future.
Locals question the role of SMC’s ground/supervision staff who as per them failed to monitor the construction and allowed the owner to carry forward the construction in violation of the building’s permission.
A response served by Joint Commissioner Planning(SMC) in response to the owner’s representation seeking permission for raising the structure in columns on dated 10th of May 2018 that lies with Good Morning Kashmir permits desired construction as per the approved plan.
“Your representation for the raising of your residential house in column structure has been considered. You are allowed to raise the construction in column structure under the close supervision of a registered structure engineer. However, you may adhere to the approved sanctioned plan. Any deviation to the building permission shall render this permission null and void,” reads the response.
“It is unfortunate that this construction was allowed in broad daylight that too in violation of laws. Such is the disregard for law that they don’t even care about the law,” locals alleged.
“When it has been already intimated to the owner that any deviation to the approved plan shall render the permission null and void, then why it has been put into abeyance and not cancelled,” locals questioned.
Danish Malik, owner of the under construction commercial complex told Good Morning Kashmir that they have not done any new construction of the building after the SMC’s order.
“We have the permission for the work, and we have done all construction accordingly. The SMC’s order is being respected in letter and spirit,” he said. Asked about the violation of norms he said, “we are four brothers, our family is big, that is why we are constructing such a big house,” he added.
Meanwhile, Good Morning Kashmir have raised this issue before the administration but nothing has been done but only false promises.
City’s Mayor, Junaid Mattu didn’t responded to calls from this reporter, despite repeated attempts.
Meanwhile, the locals urge the Lieutenant Governor administration to immediately cancel the said permission and demolish the structure. They also demand that investigation is initiated against the officials of SMC who modified the permission and allowed construction in violation of the permission granted initially.
